NOTICE OF PETITION TO SUBMIT TO A POPULAR VOTE THE CREATION AND FUNDING OF A TRANSPORTATION DEVELOPMENT DISTRICTNotice is hereby given to all persons residing or owning real property in the municipal boundaries of the City of Kirkwood, Missouri, within the state of Missouri (the "City"), that a petition has been filed asking that upon voter approval, a transportation development district by the name of "Kirkwood City-Wide Transportation Development District" (the "District") be formed for the sole purpose of funding, promoting, planning, designing, constructing, improving, maintaining and operating one or more "projects" within the meaning of Section 238.202.1(5) of the Act or assisting in such activity (the "Transportation Project"). The petition also requests voter approval of the following methods of funding the proposed District, which may increase the total taxes imposed within the proposed District: a transportation development sales tax at a rate of one-half of one percent (.50%) on the receipts from the sale at retail of all tangible personal property or taxable services at retail within the proposed District, if such property and services are subject to taxation by the State of Missouri pursuant to the provisions of Sections 144.010 to 144.525 of the Revised Statutes of Missouri, as amended. A copy of this petition is on file and available at the Office of the Clerk of the Circuit Court of St. Louis County, Missouri located at 105 South Central Avenue, Clayton, Missouri 63105. You are notified to join in or file your own petition supporting or answer opposing the creation of the transportation development district and requesting a declaratory judgment, as required by law, no later than June 14, 2024. You may show cause, if any there be, why such petition is defective or proposed transportation development district or its funding method, as set forth in the petition, is illegal or unconstitutional and should not be submitted for voter approval at a general, primary or special election as directed by this Circuit Court of St. Louis County, Missouri. Notice is also given that a public hearing will be held to consider the question of the creation and funding of the proposed District on May 29, 2024 at 9:00 am, in Division 2 of the St. Louis County Circuit Court, 105 S. Central, Courtroom 486, Clayton, Missouri, 63105, which the public may attend in person.
