In re: Legacy Truman, LLC, a Delaware limited liability company (“Grantor”)SUCCESSOR TRUSTEE'S SALE - For default in the performance of obligations due under that certain Trust Deed, Assignment of Rents, Security Agreement, and Financing Statement (“Deed of Trust”) dated December 3, 2019 and recorded with the Recorder of Deeds for Jackson County, State of Missouri on December 3, 2019 as Instrument Number 2019E0099520 executed by Legacy Truman, LLC, a Delaware limited liability company (the “Grantor”) as modified by that certain Partial Deed of Release recorded February 26, 2020 as Instrument Number 2020E0016673 and Release of Lot 10E recorded February 23, 2023 as Instrument Number 2023E0011198 whereas the legal holder of the Note has exercised its option to declare all unpaid debt evidenced by said Note immediately due and payable, the undersigned successor trustee, at the request of the legal holder of said Note, will on April 16, 2024 between the hours of 9 o'clock a.m. and 5 o'clock p.m. (2:00 p.m.), at the North front door of the Jackson County Courthouse, 415 East 12th Street in the City of Kansas City, State of Missouri, sell at public vendue to the highest bidder for cash, the following real estate described in said deed of trust and situated in Jackson County, State of Missouri, to-wit: (1) All right, title and interest in and to that real property situated in Grandview, Missouri, more particularly described as: TRACT 2: LOTS 1 AND 2, TRUMAN'S MARKETPLACE, A SUBDIVISION IN THE CITY OF GRANDVIEW, JACKSON COUNTY, MISSOURI. To the extent any property covered by this Deed of Trust consists of rights in action or personal property covered by the Uniform Commercial Code, this Deed of Trust constitutes a security agreement and is intended to create a security interest in such property in favor of Beneficiary. This Deed of Trust shall be self-operative with respect to such property, but Grantor agrees to execute and deliver on demand such security agreements, financing statements and other instruments as Beneficiary may request in order to impose the lien hereof more specifically upon any of such property. If the lien of this Deed of Trust on any property be subject to a prior security agreement covering such property, then in the event of any default hereunder, all the right, title and interest of Grantor in and to any and all deposits thereon is hereby assigned to Beneficiary, together with the benefit of any payments now or hereafter made thereon; (7) All right, title and interest of Grantor in and to all streets, roads and public places, opened or proposed; and all easements and rights of way, public or private, now or hereafter used in connection with the real property and premises thereon; (8) All awards or payments, including interest thereon, and the right to receive the same, which may be made with respect to the property referred to above as a result of (i) the exercise of the right of eminent domain, (ii) the alteration of the grade of any street, or (iii) any other injury to or decrease in the value of such property, together with any amounts received by Grantor in settlement in lieu of any of the foregoing, to the extent of all amounts which may be secured by this Deed of Trust at the date of receipt of any such award or payment by Beneficiary, and of the reasonable attorney fees, costs and disbursements incurred by the Trustee or Beneficiary in connection with the collection of such award or payment. Grantor agrees to execute and deliver, from time to time, such further instruments as may be requested by Beneficiary to confirm such assignment to the Trustee and Beneficiary of any such award or payment. (9) All right, title and interest in and to all tangible and intangible personal property, now owned or hereafter acquired by Grantor necessary to the real property. Such leasehold interests, real and personal property, together with such tenements, hereditaments, appurtenances, reversions, rents, issues, profits, buildings, easements, equipment, fixtures, awards, and any other property interest referred to in Subparagraphs 1, 2, 3, 4, 5, 6, 7, 8 and 9 above are hereinafter referred to as the "Property."
