NOTICE OF PUBLIC HEARINGIn accordance with Chapter 400 (Zoning Code) of the Code of Ordinances of the City of St. Charles, Missouri, notice is hereby given that the Board of Adjustment will conduct a public hearing on Monday, April 8, 2024, at 6:00 p.m. on the fourth floor of City Hall in the City Council Chambers, 200 North Second Street in St. Charles, Missouri for the purpose of giving interested parties and citizens an opportunity to be heard on the following matters: 1. Case No. BOA-2024-01. Address: 3971 Huster Road (Greg Meyer - 207 LLC) A request to appeal the decision/determination of an administrative official via Section 400.1080(A)(1) of the City of St. Charles Code of Ordinances. This request is specific to challenge the decision/determination of City Staff that this land use is properly designated as and regulated by Section 400.320(C)(1)(k) of the City of St. Charles Code of Ordinances: "Temporary storage of new and used motor vehicles, recreational vehicles, boats, and trailers if permitted as a conditional use in the underlying zoning district. All stored vehicles, boats, and trailers must be in operable condition." The applicant alleges this is an incorrect decision/determination by an administrative official and that the land use is as provided by Section 400.240(B)(1) of the City of St. Charles Code of Ordinances: "Wholesale establishment, truck terminal or warehouse not in excess of fifteen thousand (15,000) square feet of floor area". The property is currently zoned I-1/WHP Light Industrial District and within the Wellhead Protection District (Ward 8). This item was TABLED at the March 11, 2024 Board of Adjustment meeting to the April 8, 2024 Board of Adjustment meeting. 2. Case No. BOA-2024-04. Address: 144 Oakleigh Park Lane (Audrey Schoem) A request to decrease the minimum setback of an accessory building from the main building from ten (10) feet to one and a half (1.5) feet as regulated in Section 400.530(A)(4) of the City of St. Charles Code of Ordinances. The property is zoned PD-R Planned Development Residential (Ward 5). 3. Case No. BOA-2024-05. Address: 739 S. Duchesne Drive (Greg Stinson & Nichole Torpea - The Bee Garden Center) Two Requests: 1) A request to increase the maximum floor area per establishment from three thousand (3,000) square feet to four thousand five hundred (4,500) square feet as regulated in Section 400.210(D)(6) of the City of St. Charles Code of Ordinances, and 2) A request to decrease the minimum rear yard setback from the building line to the property line from twenty-five (25) feet to twenty (20) feet as regulated in Section 400.210(D)(5)(c) of the City of St. Charles Code of Ordinances. The property is zoned C-1 Neighborhood Business District (Ward 9). All applications, maps and plans for the above items as received from the applicants are available by the office of the Department of Community Development, 200 North Second Street, St. Charles, Missouri, during regular business hours of 8:00 a.m. to 5:00 p.m. Monday through Friday.
