Notice of Judicial Auction Sale on April 10, 2019 at 10:00am with registration from 9:30am to 10:00am. Place of Sale: 16663 Clayton Road, Wildwood, Missouri 63011; Property May Be Inspected: Open House on April 2, 2019 from 10:00am to noon and April 9, 2019 from 3:00pm to 4:00pm. Physical Address: 16663 Clayton Road, Wildwood, Missouri 63011; Single family residence, four-bedroom, three-bath home. Legal description: Lot 263 of Winding Trails Plat 1, according to the Plat thereof recorded in Plat Book 192 Page 12 of the St. Louis County Recorder's Office. County of St. Louis, State of Missouri. MINIMUM BID - $217,500.00; Mail-in bids due by April 5, 2019. Under the authority in Title 26 U.S.C. Section 7403(c) and Title 28 U.S.C., Section 2001 and 2002, the property described below will be sold pursuant to the Order of Sale filed on April 9, 2018 entered in the United States of America v. A. Dennis Brooks, et. al., Civil No. 4:17-cv-01474-AGF, in the United States District Court for the Eastern District of Missouri Eastern Division. The sale of the property shall be free and clear of any interests of the defendants. The sale shall be subject to building lines, if established, all laws, ordinances, and governmental regulations (including building and zoning) affecting the property, and easements and restrictions of record, if any. The sale shall be subject to a minimum bid requirement in the amount of not less than $217,500.00. The successful bidder shall be required to deposit with the IRS PALS a minimum of ten percent (10%) of the minimum amount bid or $21,750.00 at the time of sale. Payment to be in the form of a certified or cashier's check payable to the Clerk of the United States District Court for the Eastern District of Missouri. Before bidding at the sale, prospective bidders must display proof to the IRS PALS that they are able to comply with this requirement. No bids will be received from any person who has not presented said proof. The successful bidder shall tender the balance of the purchase price, in certified funds payable to the United States District Court for the Eastern District of Missouri, at the office of the Internal Revenue Service, Attn: Deborah Whitfield, PALS, 2937 S. Claremont Avenue, Springfield, MO 65804 on or before 3:00 p.m., within forty-five (45) days from the date of sale, which is May 24, 2019. In the event that the purchaser fails to fulfill this requirement, the deposit shall be forfeited and retained by the Internal Revenue Service as part of the proceeds of sale, and the Property shall be re-offered for sale or be offered to the second highest bidder. The U.S. may bid as a creditor against its judgment without tender of cash. The sale of the Real Property shall be subject to confirmation by this Court. Upon confirmation of the sale and receipt of the entire purchase price, IRS shall issue and deliver to the purchaser, a deed conveying the real property to the purchaser. Upon confirmation of the sale, all interests in, liens against, or claims to, the real property that are or may be asserted by any of the parties to this action are discharged and extinguished. The United States reserves the right to reject any and all bids and to withdraw the property from sale. When the sale is confirmed by the court, the Recording Official of St. Louis County, Missouri shall cause the transfer of the real property to be reflected upon that county's register of title.
