NOTICE OF ELECTION Notice is hereby given that the Brentwood Boulevard/Clayton Road Community Improvement District (the "District"), which consists of approximately 2.54 acres of real property and is generally bounded by and adjacent to Brentwood Boulevard to the west, Clayton Road to the north, Interstate 170 to the east and existing retail and office space to the south, in the City of Richmond Heights, Missouri, will hold an election by mail on Tuesday, December 11, 2018. The purpose of this election is to put forth to the qualified voters the proposal of an extension of the community improvement district-wide sales and use tax (the "CID Sales Tax"), approved by the qualified voters of the District on April 23, 2013 and currently imposed by the District at a rate of one percent (1%), until no later than September 30, 2053 unless such CID Sales Tax is terminated earlier by the District, which CID Sales Tax shall be levied on the receipts from the sale at retail of all tangible personal property or taxable services at retail within the District, if such property and services are subject to taxation by the State of Missouri pursuant to Sections 144.010 to 144.525 of the Revised Statutes of Missouri, as amended (the "Statutes") except sales of motor vehicles, trailers, boats or outboard motors and sales to or by public utilities and providers of communications, cable or video services, for the purpose of providing revenue to repay any obligations (a) to demolish and remove, renovate, reconstruct, or rehabilitate privately-owned structures located within the District's boundaries; (b) to construct public improvements within the boundaries of the District as permitted by the Community Improvement District Act, Sections 67.1401 to 67.1571 of the Statutes, including but not limited to: (i) lawns, trees and other landscaping; (ii) sidewalks, internal streets, internal traffic signs and signals, utilities, drainage, water, storm and sewer systems, and other site improvements; (iii) parking lots; and (iv) streetscape, lighting, benches or other seating furniture, trash receptacles, marquees, awnings, canopies, walls, and barriers; and (c) to provide for professional fees, including without limitation legal and accounting, architectural and engineering, marketing and advertising, approvals, permits, inspections and other fees, and funding of the City of Richmond Heights, Missouri's expenses. Qualified voters for this election will consist of: a. Such persons who reside within the District and who are qualified and registered to vote pursuant to Chapter 115 of the Statutes, pursuant to the records of the election board as of the thirtieth day prior to the date of the applicable election; or b. If no registered voters reside in the District, the owners of one or more parcels of real property located within the District per the real property tax records of the county assessor as of the thirtieth day before the date of the applicable election. In order to be a qualified voter for purposes of the election, persons residing in the District shall register to vote with the election board or own real property within the District on or before November 11, 2018. The ballot must be returned to the election board's office, located at the St. Louis County Election Board, 725 Northwest Plaza Drive, St. Ann, Missouri 63074, in person, or by depositing the ballot in the United States mail addressed to the election board's office and postmarked not later than the date of the election. Ballots will be mailed to qualified voters on or about November 26, 2018 in accordance with the CID Act. Any qualified voter that did not receive a ballot in the mail or lost the ballot received in the mail may pick up a mail-in ballot at the election board's office, between the hours of 8:00 a.m. and 4:30 p.m. after November 26, 2018.
