NOTICE OF PETITION FOR THE CREATION OF A TRANSPORTATION DEVELOPMENT DISTRICT Notice is hereby given to all persons residing or owning property in the approximately 16 acres of real property generally located in an area bounded by Orf Road to the north, Highway N to the west, and Old Highway N to the south, that a petition has been filed asking that a transportation development district by the name of "SOUTH RIDGE TRANSPORTATION DEVELOPMENT DISTRICT" be formed for the purpose of developing the following transportation project: (a) construction of a three lane cross section on Orf Road between relocated Missouri Route N and Hawk Ridge Trail; (b) construction of new public roads within the boundaries of the proposed District; (c) creation of a turning/deceleration lane from relocated Missouri Route N onto Orf Road; (d) the widening of Hawk Ridge Trail at or near its intersection with Orf Road and, in relation thereto, the construction of a two-way left turn land for westbound traffic on Hawk Ridge Trail; and (e) grading, drainage, pavement, curbing, gutters, sidewalks, storm water facilities, structures (including any architectural treatments related thereto), signage, striping, lighting, traffic signals, landscaping, irrigation systems, utility relocation or other similar or related infrastructure or improvements in connection with items (a) and (d) above, as applicable. The petition also requests qualified voter approval of the following methods of funding the proposed district, which may increase the total taxes imposed within the proposed district: a transportation development sales tax at a rate of one percent (1%) for up to 30 years on the receipts from the sale at retail of all tangible personal property or taxable services at retail within the proposed district, if such property and services are subject to taxation by the State of Missouri pursuant to the provisions of Sections 144.010 to 144.525 of the Revised Statutes of Missouri, as amended, except such sales tax shall not apply to the sale or use of motor vehicles, trailers, boats or outboard motors nor to public utilities. A copy of this petition in Case No. 1711-CC00982 is on file and available at the office of the clerk of the circuit court of St. Charles County, located at 300 North 2nd Street, St Charles, Missouri 63301. You are notified to join in or file your own petition supporting or answer opposing the creation of the transportation development district and requesting a declaratory judgment, as required by law, no later than the April 9, 2018. You may show cause, if any there be, why such petition is defective or proposed transportation development district or its funding method, as set forth in the petition, is illegal or unconstitutional and should not be submitted for voter approval at a general, primary or special election as directed by this court. Notice is also given that a public hearing will be held to consider the question of the creation and the funding method of the proposed transportation development district on April 9th, 2018, at 3:00 p.m., at the Lake Saint Louis City hall, 200 Civic Center Drive, Lake Saint Louis, MO 63367.
